TERMS & CONDITIONS

It is the responsibility of all clients to read the Terms and Conditions outlined by LA Designer Hire before hiring. These terms form a legally binding contract which LA Designer Hire reserves the right to make changes to at any time.

When hiring with LA Designer Hire you automatically agree and abide to the most recent edition of the Terms and Conditions.

We strongly recommend that you revisit these terms each time you hire with LA Designer Hire to ensure you are familiar with any amendments.

 

Definitions:

Throughout the website, the terms "LA Designer Hire", “we’, “us” and “our” refer to LA Designer Hire (ABN 73 126 696 605). The terms “you” and “your” refer to all users and consumers of this website ( http://www.ladesignerhire.com.au/ )

 

By hiring with LA Designer Hire, you immediately agree to all following Terms and Conditions: 

01 Bookings & Payments

1.1. For security purposes, bookings are ONLY confirmed once full payment has been made and sufficient client information has been provided. Such information includes, but is not limited to, Full Name, Email Address, Phone Number, Postal Address, and a government recognised ID.

1.2 LA Designer Hire reserves the right to cancel a booking if:

  • Full payment is not made
  • Sufficient client information is not provided
  • A garment is damaged by a previous borrower, is delayed, or is no longer available for use.

1.3 If LA Designer Hire is responsible for cancelling a booking and payment has been made, the client will receive a full refund.

Please note refunds via Shopify take approximately 10 days to be processed.

1.4  The default rental period is 3-days. If you require an extended hire period these can be booked via DM, or email. All extended hires are only requests until a fee of 70% of the hire price has been paid. Once the payment has been secured, the request will be approved and the new return date will be confirmed. 

 

02 Cancellations, Refunds & Store Credits

If you wish to cancel your booking, please notify LA Designer Hire immediately.

2.1 LA Designer Hire does NOT OFFER REFUNDS OR STORE CREDITS for cancellations made within 14 business days prior to the rental period.

2.2 Any cancellations made at least 14 business days prior to the rental period are ONLY entitled to a store credit lasting 12 months, minus a $30 cancellation fee.

2.3 COVID-19 & Natural Disaster Cancellations: If your event has been cancelled due to a natural disaster (such as flooding), COVID-19 restrictions, lockdown or quarantine, LA Designer Hire will issue a store credit lasting 12 months. To obtain this store credit, you may be asked to provide sufficient evidence, including, but not limited to, a medical certificate, positive COVID-19 test result, or government documentation. If such evidence is not presented, LA Designer Hire holds the right to withhold a store credit.

2.4 Refunds and store credits DO NOT apply in cases where a garment shows minor signs of wear and tear. Minor signs of wear and tear are defined as, but not limited to, small marks or tears, loose threading, discolouration, etc.

2.5 If a garment is faulty to the extent that it is unwearable a refund will be awarded at our discretion.

To qualify for a refund, you must notify LA Designer Hire immediately and send through photo evidence of any damage WITHIN 3-HOURS OF DELIVERY OR PICK UP. If LA Designer Hire is not notified within this time or sent photo evidence, you may be responsible for the damage.

The faulty garment must be returned “unworn”, defined as not being used, or never having ever been used, WITHIN 24-HOURS OF DELIVERY OR PICK UP. If the garment is returned late and you are unable to provide proof of postage or drop off within this 24-hour period, you will not be entitled to a refund or store credit.

We will notify you once we have received and inspected your garment, prior to any refund being approved and processed. In cases where an item is deemed as having minor damage but remains in "wearable" condition a refund will not be awarded. LA Designer Hire holds the right to determine the extent of compensation given. In cases where an item is deemed as an "unwearable condition", you will receive a refund including the full hire fee minus the shipping costs. This amount will be automatically refunded through your original payment method.

  • Please note: Shopify refunds take approximately 10 days to be processed. In addition, it can take extra time for your bank and/or credit card company to process the refund.
  • If more than 15 business days have passed since we approved your return refund, please contact us at info@ladesignerhire.com.au.

2.6 Refunds DO NOT apply to sizing errors. If a garment does not fit correctly, local pick-up bookings are entitled to an exchange. To qualify for an exchange, you must notify LA Designer Hire and arrange an exchange time WITHIN 3-HOURS OF PICK UP. Postage orders are not eligible for sizing exchanges.

2.7 LA Designer Hire does not offer refunds, returns, or store credits on sale items. All sales are final.

 

Please note: Store credits do not apply to postage fees. If a store credit is used towards a more expensive garment, the difference must be paid.

 

03 Returns

3.1 All garments must be returned either via local drop off, or to a local post office via a YELLOW EXPRESS POSTAGE BIN by 5pm on the return date listed on the booking, or by Monday at 5pm following a weekend hire. Late fees will apply to garments returned after this period (unless discussed otherwise). 

  • Local Returns: For local returns, please simply return the garment in the LA Designer Hire bag provided and follow the Return Instructions outlined in our return email.
  • Postage Returns: If returning via Australia Post, please return in the reusable Hero Packaging mailer provided by LA Designer Hire, or via an EXPRESS postage bag. This mailer should be taken to your nearest post office and returned either over the counter (highly recommended for proof of lodgement) or in a YELLOW EXPRESS POSTAGE BIN.

3.2 If the item is not returned by the times outlined above, the client will be charged a $30.00 late fee for every day the item is returned late.

3.3 If returned 3 or more days late, LA Designer Hire holds the right to charge you the following clients hire fees, reflecting any lost bookings.

3.4 By accepting these terms, you give permission for LA Designer Hire to charge late fees to the original payment method used when placing your booking.

3.5 Any invoices for late fees must be paid within 14 days of the invoice date. If not paid within this time the matter will be referred to a debt collector and credit agency.

 

04 Garment Care & Damages

4.1 At LA Designer Hire, we carefully hand wash all garments. Dry cleaning is not included in the hire price.

4.2 The client is required to take care when handling garments, particularly around food, drinks, makeup, fake-tan, jewellery, and bags (which may scratch or pulls at materials such as silk, wool, cotton or polyester).

4.3 Please note: All garments are hire items. This means that our products have been worn by other consumers prior to your hire. Although we strive to uphold the best quality garments, minor signs of wear and tear may be present. Minor signs of wear and tear will NOT be eligible for a refund or store credit.

4.4 When booking with LA Designer Hire you agree that you will make no attempts to clean, alter, iron, or tumble dry garments (unless arranged otherwise).

If a garment is damaged, please do not attempt to clean garments yourself as it may damage the material and you may become responsible for greater damage costs. Simply let us know immediately and return the garment in the LA Designer Hire bag provided. Further action will be determined upon inspection.

4.5 If a garment is returned in poor condition, is damaged or requires extra professional cleaning, you, as the client, will be responsible for ALL repair costs and will be required to pay the full RRP replacement fee if damage is beyond repair.

4.6 If another hire is impacted by the damage, or extra cleaning is required leading to cancellation of other hires, the client will be required to pay any resulting lost hire fees.

4.7 If you are required to pay the full RRP replacement fee, you are entitled to keep the garment in the condition it has been returned in.

 

05 Try On Appointments

We offer 30-minute try on appointments in Kenmore Hills, QLD, 4069.

LA Designer Hire requires a $15 upfront fee to book a Try On Appointment.

 

5.1 If the client wishes to hire a try on garment within 48 hours of the try on this amount is deducted from the hire price. If the client does not wish to go ahead with a garment within this 48-hour period, the $15 fee will not be deducted nor will it be refunded.

5.2 If the client cancels within 24 hours or does not show up to the appointment this fee will not be refunded.

5.3 Damages during a Try On Appointment will be treated the same as damages from a rental (refer to 04 Garment Care & Damages)

5.4 Please refrain from wearing makeup or fresh fake tan to a try on appointment as any stains that come as a result will be treated as damages (refer to 04 Garment Care & Damages). These may require cleaning fees and/or full RRP in the case of non-repairable damage.

 

06 Pick up Information

6.1 Pick-ups are available from Thursday onwards (Thursday, Friday, and Saturday, inclusive). If you need to arrange and alternative pick up date, this must be arranged prior to placing your booking.

6.2 Last minute pick up orders are usually ready within 24 hours; however, you must contact us via DM @ladesignerhire prior to booking so we can confirm the garment is available.

 

07 Postage Information

We ship Australia-wide from Kenmore Hills, QLD, 4069 using reusable Hero Packaging mailers.

All garments are sent via Express Postage on Tuesdays, or the nearest possible convenience, prior to bookings.

 

PLEASE NOTE:

All postage orders for weekend bookings MUST BE PLACED NO LATER THAN TUESDAY 12:00PM AEST prior to the booking date.

Refunds will NOT be awarded if delivery orders placed past the Tuesday 12:00PM cut-off arrive late.

All parcels are marked authority to leave. If you require your parcel to be signed on delivery, you must specify this in the delivery instructions at check out.

7.1 Our most popular and recommended postage option is Express Return Postage.


This includes express postage to you in a Hero Pack return mailer with a ready-to-use return label which you can simply attach to the mailer and send the garment back to us in.

Postage Returns

7.2 All garments must be lodged using the reusable Hero Packaging mailer provided, or via an EXPRESS postage bag, by 5pm on the final hire date.

Please ensure the mailer is returned by lodging it OVER THE COUNTER at an Australia Post outlet and you receive proof of lodgement, or in a YELLOW EXPRESS POSTAGE BIN.

7.3 If items are not lodged by Monday 5pm after the hire period, or 5pm on the end of hire date, a $30 late fee will be charged for every day the item is returned late (refer to 03 Returns for more details).

7.4 Refunds DO NOT apply to any posted hire bookings after a garment has been posted.

 

08 Liability

8.4 LA Designer Hire is not liable for delays in Australia Post. All garments are sent via Express Postage on Tuesdays, or the nearest possible convenience, prior to bookings. It is the responsibility of the client to calculate how long a garment may take to arrive to their delivery address and choose the postage option at their own risk. If the client requires early postage, LA Designer Hire must be informed prior to booking. Refunds will NOT be awarded if the parcel is delayed by Australia Post or if the client neglects to inform LA Designer Hire that early postage is required (particularly to rural or remote areas). 

 

8.5 If the tracking code shows evidence that the parcel has been lodged by LA Designer Hire with sufficient time, but the garment does not reach the client in time, LA Designer Hire will NOT issue a refund. This is due to a delay or fault with a third-party (Australia Post).

To be eligible for a store credit, you must return the garment “unworn”, defined as not being used, or never having ever been used, WITHIN 24-HOURS OF DELIVERY. If LA Designer Hire is not notified with proof of lodgement within this time, a store credit may not be awarded. Store credits will only be awarded at LA Designer Hire's discretion and do not include shipping costs. 

8.6 ​In the event of change of heart, incorrect sizing, or a cancelation after the garment has been posted, a refund will NOT be awarded.

8.7 ​If the garment is stolen/lost after package delivery, the client is liable for the full RRP replacement fee.

8.8 By signing up to LA Designer Hire you agree to receive recurring automated marketing messages via the email and phone number provided. Consent is a condition of purchase. To unsubscribe simply reply STOP. Message & Data rates may apply.

 

09 Collaborations

 

By collaborating with LA Designer Hire, the collaborator acknowledges that they have read, understood, and agreed to the outlined Terms and Conditions.

 

9.1 If you wish to collaborate with LA Designer Hire, you must secure your booking through Shopify.

9.2 All collaborators must pay the $30 postage fee. This fee will not be refunded in any case.

9.3 All collaboration agreements must be fulfilled. If a collaborator fails to fulfil an agreement, they will be required to pay LA Designer Hire reimbursement or compensation fees for damages caused by loss of hires. The amount of compensation will be decided by LA Designer Hire and may vary depending on the extent of losses incurred.

9.4 All collaborators are expected to handle garments the same as all clients. Collaborators will be liable for any damage or late return fees, as previously mentioned.

9.5 As stated in Garment Care & Damages, all garments are hire items. Minor signs of wear and tear may be present and will NOT be eligible for a refund or store credit. 

9.6 Any content that arises from a collaboration with LA Designer Hire automatically becomes the intellectual property of LA Designer Hire and the model. This means content is not permissible to be reshared or reposted by other parties including but not limited to other Instagram accounts, websites or Tiktok profiles.
